1. Acceptance of These Terms

By accessing or using usstonegroup.com (the "Site"), browsing our stone inventory, requesting a quotation, or placing an order, you agree to be bound by these Terms & Conditions and by our Privacy Policy. If you do not agree, please do not use the Site.

2. Who We Are

The Site is operated by US Stone Group ("US Stone Group", "we", "us", "our"), 14731 Goldenwest St, Westminster, CA 92683, USA. References to "you" mean the person or entity using the Site.

3. Eligibility and Use of the Site

You must be at least 18 years old and able to form a binding contract to use this Site. You agree not to misuse the Site, interfere with its operation, attempt unauthorized access to any part of it, scrape or harvest data by automated means, or use it for any unlawful purpose.

4. Product Information and Natural Variation

Natural stone is a product of nature. Colour, veining, pattern, tone, thickness and finish vary from slab to slab and from lot to lot. Photographs, samples and digital renderings on the Site are indicative only and are not an exact representation of the material you will receive. We strongly recommend viewing and approving the specific slab or lot before purchase. Variation in natural material is not a defect and is not a valid basis for rejection or return.

5. Inventory and Availability

Slab counts, lot availability and product listings shown on the Site are drawn from our inventory system and are refreshed periodically. They are provided for guidance only, may be cached for a short period, and do not constitute a guarantee that any item remains available. All orders are subject to confirmation of availability by us.

6. Pricing and Quotations

Prices displayed or quoted are in US dollars and exclude sales tax, delivery, fabrication, installation and any other charges unless expressly stated. Prices are subject to change without notice. A written quotation is valid for the period stated on it, or thirty (30) days if no period is stated. We reserve the right to correct pricing or descriptive errors at any time, including after an order is submitted, in which case you may cancel the affected order for a full refund.

7. Orders and Payment

Submitting an order, enquiry or custom order request is an offer to purchase and does not create a binding contract. A contract is formed only when we issue a written confirmation or invoice. We may decline or cancel any order at our discretion. Payment terms, deposits and balance due dates will be set out on your invoice. Title to goods passes to you only upon receipt of payment in full.

8. Delivery, Pickup and Risk of Loss

Delivery and pickup dates are estimates and are not guaranteed. We are not liable for delays caused by events outside our reasonable control. Risk of loss or damage passes to you upon delivery or, for pickup orders, upon loading. You or your carrier are responsible for inspecting material at that time and for noting any visible damage or shortage before leaving our premises.

9. Returns, Cancellations and Custom Orders

Requests to cancel or return must be made in writing. Special-order, imported, cut-to-size, fabricated and custom items are non-cancellable and non-returnable once production or shipment has begun. Approved returns of standard stock may be subject to a restocking fee and must be in original, uninstalled and undamaged condition. Material that has been cut, fabricated, sealed or installed is deemed accepted and cannot be returned.

10. Inspection Before Fabrication

You are responsible for inspecting all material for colour, finish, size, quantity and visible defects before any cutting, fabrication or installation. Claims relating to matters that would have been apparent on reasonable inspection cannot be accepted once fabrication has begun.

11. Warranties and Disclaimer

Except as expressly stated in writing, the Site and all products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that inventory data will be complete or current.

12. Limitation of Liability

To the fullest extent permitted by law, US Stone Group shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost business, or the cost of fabrication, installation, removal or replacement labour. Our total aggregate liability arising out of or relating to the Site or any order shall not exceed the amount you actually paid to us for the specific product giving rise to the claim.

13. Intellectual Property

All content on the Site, including text, photographs, graphics, logos, product imagery and the compilation of inventory data, is owned by or licensed to US Stone Group and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, republish or create derivative works from any part of the Site without our prior written permission.

14. Third-Party Links and Services

The Site may contain links to third-party websites, mapping services, payment processors and analytics providers. We do not control and are not responsible for the content, products, security or privacy practices of any third party. Accessing them is at your own risk.

15. Privacy and Cookies

Information you provide through the Site is handled in accordance with our Privacy Policy. The Site uses cookies and similar technologies; you can manage your preferences through the cookie notice on the Site.

16. Indemnification

You agree to indemnify and hold harmless US Stone Group and its officers, employees and agents from any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You agree that the exclusive venue for any dispute shall be the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.

18. Changes to These Terms

We may update these Terms at any time. The revised version takes effect when posted on this page. Your continued use of the Site after posting constitutes acceptance of the updated Terms. Please review them periodically.

19. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will continue in full force and effect.

1. About This Policy

This Privacy Policy explains, in plain language, what personal information US Stone Group gathers when you visit usstonegroup.com, why we gather it, who we share it with, and what choices and legal rights you have over it. We have tried to avoid unnecessary jargon. If anything here is unclear, please ask us and we will explain it.

2. Who We Are

US Stone Group is the operator of this website and the party responsible for deciding how your personal information is handled (a "controller" under some privacy laws). You can reach us at 14731 Goldenwest St, Westminster, CA 92683, USA, by email at info@usstonegroup.com, or by telephone on +1 (833) 844-2500.

3. What This Policy Covers

This Policy applies to this website and to enquiries, quotation requests, orders and marketing communications that arise from it. It does not apply to other companies' websites that we link to, or to information you give to a fabricator, installer, designer or other third party you engage separately.

4. Information You Give Us Directly

When you contact us, request a quotation, submit a custom order enquiry, subscribe to updates or create an account, you may give us your name, company name, email address, telephone number, postal or delivery address, the materials and quantities you are interested in, project details, and anything else you choose to include in a message. If you place an order, we will also hold order, invoice and delivery records. Payment card details are handled by our payment providers and are not stored on our systems.

5. Information Collected Automatically

Like most websites, ours records certain technical information whenever a page is loaded. This can include your IP address, approximate region derived from it, browser and device type, operating system, screen size, the pages you viewed and how long you stayed, the site or search engine that referred you, and the date and time of your visit. This information is used to keep the site working, to protect it from abuse, and to understand which parts of our inventory people find useful.

6. What Cookies Are

A cookie is a small text file that a website asks your browser to store on your device. On its own it is not a program and cannot damage your device or read your files. It simply lets the site recognise your browser on a later page or a later visit, so that things like your language, your consent choices and the contents of your basket are not forgotten between clicks.

7. How Long Cookies Last

Some cookies are temporary and disappear the moment you close your browser; these are usually called session cookies and are what keep you logged in or keep a form filled while you move between pages. Others are stored for a defined period and survive until they expire or until you clear them; these are usually called persistent cookies and are what remember your preferences or your cookie consent on your next visit.

8. Categories of Cookies We Use

Our cookie banner groups cookies into categories. Strictly necessary cookies make the site function at all, including security, load balancing, session handling and remembering your consent choices; these cannot be switched off. Functional cookies remember preferences and enable features such as forms and embedded content. Analytics and performance cookies help us count visits and see which pages perform poorly, generally in aggregated form. Advertising cookies may be used to measure the effectiveness of campaigns and to show you relevant material on other platforms. You can accept or decline every category except the strictly necessary ones.

9. Third-Party Services We Use

We rely on established third-party providers to run parts of this site, and some of them set their own cookies or receive technical data. These include our website and hosting platform, Google Tag Manager and Google's analytics and advertising products, social and commerce integrations for platforms such as Meta, Pinterest and TikTok, our email and marketing tools, our cookie consent manager, spam filtering on forms, our order and inventory systems, and cloud storage used to deliver product photographs. Each provider handles data under its own privacy policy, and we encourage you to read those if you would like more detail.

10. Why We Use Your Information

We use personal information to respond to enquiries and prepare quotations, to process and deliver orders and handle payment and returns, to keep records required for tax and accounting, to operate and secure the website, to detect and prevent fraud or misuse, to measure and improve how the site performs, to send you marketing where you have asked for it or where the law otherwise permits it, and to comply with our legal obligations.

11. Our Legal Grounds (Visitors in the UK and EEA)

If you are located in the United Kingdom or the European Economic Area, we rely on the following grounds: performance of a contract, where we need the information to supply a quotation or fulfil an order; our legitimate interests in operating, securing, analysing and promoting our business, balanced against your rights; your consent, for non-essential cookies and for marketing email, which you may withdraw at any time; and compliance with a legal obligation where a law requires us to keep or disclose information.

12. When We Share Your Information

We share personal information only where there is a reason to. That includes our service providers and processors acting on our instructions, such as hosting, analytics, email delivery, payment processing, freight and delivery partners; professional advisers such as accountants and lawyers; public authorities where we are legally required to disclose; and a buyer or successor if our business or its assets are ever transferred. We require our providers to protect your information and to use it only for the purpose we engaged them for.

13. Selling and Sharing for Advertising

We do not sell your personal information for money. However, some advertising and analytics cookies may involve disclosures that certain laws, including California's, treat as "selling" or "sharing" for cross-context behavioural advertising. If you would prefer this not to happen, decline the advertising category in our cookie banner, or contact us using the details below and we will action your request.

14. Your Rights If You Are in California

California residents have the right to know what personal information we have collected about them and how it has been used and disclosed; to request a copy of it; to ask us to correct information that is inaccurate; to ask us to delete it; to opt out of any sale or sharing for cross-context behavioural advertising; and to limit the use of sensitive personal information where that applies. We will never discriminate against you, refuse service, or change your pricing because you exercised a privacy right.

15. Your Rights If You Are in the UK or EEA

If you are covered by UK or EU data protection law, you may request access to your personal data, ask for inaccurate data to be corrected, ask for data to be erased in certain circumstances, ask us to restrict how we use it, object to processing carried out on the basis of our legitimate interests or for direct marketing, and request a portable copy of data you provided to us. You may also withdraw consent at any time, and you have the right to complain to your national data protection authority.

16. How to Make a Privacy Request

Send your request to info@usstonegroup.com and tell us what you would like us to do. So that we do not disclose your information to the wrong person, we may ask you for enough detail to confirm your identity, such as matching an email address or order reference already on file. We aim to acknowledge requests promptly and to respond within the period required by the law that applies to you. An authorised agent may act on your behalf if they provide written proof of authority. Making a request is free unless it is clearly excessive or repetitive.

17. Managing Cookies Yourself

You can change your mind about cookies at any time using the consent controls on this site. Separately, every mainstream browser lets you block cookies, delete cookies already stored, or warn you before one is set, usually under a privacy or site-data setting. Blocking all cookies is your right, but please be aware that parts of this site, including forms, consent memory and basket functions, may stop working properly if you do.

18. Global Privacy Control and Do Not Track

Where your browser or an extension transmits a recognised opt-out preference signal, such as Global Privacy Control, we will treat it as a request to opt out of sale and sharing for that browser. Older "Do Not Track" browser headers are not handled consistently across the industry and we do not currently respond to them.

19. How Long We Keep Information

We keep personal information only for as long as there is a reason to hold it. Enquiries and quotations that do not become orders are kept for a limited period in case you come back to us. Order, invoice, tax and warranty records are kept for the longer periods that accounting and commercial law require. Marketing contact details are kept until you unsubscribe. Analytics data is generally retained in aggregated or shortened form. When information is no longer needed we delete it or render it anonymous.

20. Keeping Your Information Secure

We use appropriate technical and organisational measures to protect personal information, including encryption of traffic to and from this site, access controls, and limiting who inside the business can see what. No website or transmission over the internet can be guaranteed to be completely secure, so we cannot promise absolute security, but we take the responsibility seriously and will notify you and any regulator where the law requires us to do so following a breach.

21. Transfers Outside Your Country

We are based in the United States, and our providers may store or process information in the United States or elsewhere. If you are located outside the United States, your information will therefore be transferred to a country whose data protection laws may differ from those of your own. Where the law requires it, we put an appropriate safeguard in place, such as standard contractual clauses, to protect information that leaves your region.

22. Children's Privacy

This website is intended for business and adult consumer use and is not directed at children. We do not knowingly collect personal information from anyone under the age of sixteen. If you believe a child has provided us with personal information, please contact us and we will delete it.

23. Links to Other Websites

Our pages may link to manufacturers, mapping tools, social platforms and other external sites. Following such a link takes you outside our control, and we are not responsible for the content or the privacy practices of those destinations. Please read their own privacy notices before providing information to them.

24. Updates to This Policy

We may revise this Policy from time to time to reflect changes in our practices, our technology or the law. The current version is always the one shown on this page, and the date below tells you when it was last revised. Where a change is significant we will take reasonable steps to bring it to your attention.

25. How to Contact Us

For any question about this Policy, about how your information is handled, or to exercise a right described above, contact US Stone Group at info@usstonegroup.com, on +1 (833) 844-2500, or at 14731 Goldenwest St, Westminster, CA 92683, USA. We would always prefer to resolve a concern with you directly before you approach a regulator.
