By accessing or using usstonegroup.com (the "Site"), browsing our stone inventory, requesting a quotation, or placing an order, you agree to be bound by these Terms & Conditions and by our Privacy Policy. If you do not agree, please do not use the Site.
The Site is operated by US Stone Group ("US Stone Group", "we", "us", "our"), 14731 Goldenwest St, Westminster, CA 92683, USA. References to "you" mean the person or entity using the Site.
You must be at least 18 years old and able to form a binding contract to use this Site. You agree not to misuse the Site, interfere with its operation, attempt unauthorized access to any part of it, scrape or harvest data by automated means, or use it for any unlawful purpose.
Natural stone is a product of nature. Colour, veining, pattern, tone, thickness and finish vary from slab to slab and from lot to lot. Photographs, samples and digital renderings on the Site are indicative only and are not an exact representation of the material you will receive. We strongly recommend viewing and approving the specific slab or lot before purchase. Variation in natural material is not a defect and is not a valid basis for rejection or return.
Slab counts, lot availability and product listings shown on the Site are drawn from our inventory system and are refreshed periodically. They are provided for guidance only, may be cached for a short period, and do not constitute a guarantee that any item remains available. All orders are subject to confirmation of availability by us.
Prices displayed or quoted are in US dollars and exclude sales tax, delivery, fabrication, installation and any other charges unless expressly stated. Prices are subject to change without notice. A written quotation is valid for the period stated on it, or thirty (30) days if no period is stated. We reserve the right to correct pricing or descriptive errors at any time, including after an order is submitted, in which case you may cancel the affected order for a full refund.
Submitting an order, enquiry or custom order request is an offer to purchase and does not create a binding contract. A contract is formed only when we issue a written confirmation or invoice. We may decline or cancel any order at our discretion. Payment terms, deposits and balance due dates will be set out on your invoice. Title to goods passes to you only upon receipt of payment in full.
Delivery and pickup dates are estimates and are not guaranteed. We are not liable for delays caused by events outside our reasonable control. Risk of loss or damage passes to you upon delivery or, for pickup orders, upon loading. You or your carrier are responsible for inspecting material at that time and for noting any visible damage or shortage before leaving our premises.
Requests to cancel or return must be made in writing. Special-order, imported, cut-to-size, fabricated and custom items are non-cancellable and non-returnable once production or shipment has begun. Approved returns of standard stock may be subject to a restocking fee and must be in original, uninstalled and undamaged condition. Material that has been cut, fabricated, sealed or installed is deemed accepted and cannot be returned.
You are responsible for inspecting all material for colour, finish, size, quantity and visible defects before any cutting, fabrication or installation. Claims relating to matters that would have been apparent on reasonable inspection cannot be accepted once fabrication has begun.
Except as expressly stated in writing, the Site and all products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that inventory data will be complete or current.
To the fullest extent permitted by law, US Stone Group shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost business, or the cost of fabrication, installation, removal or replacement labour. Our total aggregate liability arising out of or relating to the Site or any order shall not exceed the amount you actually paid to us for the specific product giving rise to the claim.
All content on the Site, including text, photographs, graphics, logos, product imagery and the compilation of inventory data, is owned by or licensed to US Stone Group and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, republish or create derivative works from any part of the Site without our prior written permission.
The Site may contain links to third-party websites, mapping services, payment processors and analytics providers. We do not control and are not responsible for the content, products, security or privacy practices of any third party. Accessing them is at your own risk.
Information you provide through the Site is handled in accordance with our Privacy Policy. The Site uses cookies and similar technologies; you can manage your preferences through the cookie notice on the Site.
You agree to indemnify and hold harmless US Stone Group and its officers, employees and agents from any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You agree that the exclusive venue for any dispute shall be the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
We may update these Terms at any time. The revised version takes effect when posted on this page. Your continued use of the Site after posting constitutes acceptance of the updated Terms. Please review them periodically.
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will continue in full force and effect.
